My gf didn't naturalize and I have received a letter from USCIS stating that they were unable to find any records. Is this letter all I need to present as proof that my gf didn't become a cit for my dual cit?

Giannatatanasio,
you do not need that letter, you need a " certificate of non existence of naturalization record", I do not think that italian consulate would accept that kind of letter.
Also, since nothing was found, you need to prove your ancestor never naturalized as below:

In the event that your ancestor never became a naturalized US citizen it must be proven with a certification of "NO RECORDS" from the following:
1. USCIS, 2. NARA (National Archives), 3. the local County Court and 4. a Census Report from the US Dept. of Commerce.

Thanks Riccardo. Do these reports have to have any sort of certification, is there a type of doc in particular that I am requesting? Do you have any idea how long it took to become a citizen around 1901?

Since USCIS states you they found nothing, you need to see if there is anything in local courthouse or local NARA.
You need they issue for you a "CERTIFICATION OF NO RECORDS"
I do not know how long it took to become citizen at that time

Thanks for the help. I'm not quite sure what you mean by I need a census report. I could only find 2 census records that my gf appeared on, on, one he is only 14 and the citizenship column is blank for the whole family, the second census says he is born in New York which he was not. Do I need copies of both of these or only one?

Hello, Everyone.
I am currently going through the procedure of getting together all the documents needed for applying for dual citizenship through my father (born in the USA) and paternal grandfather (born in Potenza Italy) and have an appointment with the Italian Consulate in NY in May.

After reading this discussion, I thought I would share some information on the certificate of "Non-existence of Records" I needed for my grandfather who came to the USA and was never naturalized prior to my father's birth. I contacted the US Citizenship and Immigration Services office (part of the Dept of Homeland Security now) in June 2008. I received a letter back to let me know my request was being handled. I next received a letter from the Office of Records Headquarters with a Certificate of Non-existence of Records attached that included a raised seal.

I then ordered a certified copy of a 1930 US Census which had my grandfather listed as an Alien and showed the name of my father who was born in 1910 to help support the fact that my grandfather was never naturalized before my father was born. I received a full size copy of the census page with a gold seal and red ribbon. Very classy.

Then on April 17, 2009 I received a letter from the same agency informing me that they had compled their review and sent me 10 pages of information showing that my grandfather had filled out an Alien Registration form in 1943 (shortly before he died), a copy of his Alien Registration Receipt Card and even a copy of his fingerprints. What a surprise! It definitely is the proof needed to show my grandfather was never naturalized.

I would suggest giving yourself at least a year to obtain this information from this department but it is worth the wait if they send you this documentation.

Thanks, good story. Lucky you getting all that documentation from USCIS. I have a couple of questions if you don't mind. Where did you order your census from, is there a request form, what was the cost and did you request it by year and family name only or did you already have a copy?

What I did first was to find a US census that showed my grandfather and father listed on the same census - I was lucky as I found the 1930 census show both of them living at the same address - grandfather was listed as AL (alien), father as born in NY. So I contacted the US Department of Homeland Security - US Citizenship & Immigration Services (www.uscis.gov) to order the census - it cost $25 and I received a full size census page (11x16) which came with an attached National Archives and Records Administration certification that it was a true and correct copy - it also had a gold seal and red ribbon - very special looking. If you go to their website listed above, I believe you can order it there. You might have to fill out a Freedom of Information form - I am not sure.
Hope this helps. Again give yourself time to get this copy but they were pretty quick in sending it.
